Terms of Service

These Terms are an agreement between you and Sofiia Zaitseva ("we", "us") about your use of the Focus Kitten app and your purchase, whether you bought it on focuskitten.com or in the Mac App Store. By downloading, using, or buying Focus Kitten, you agree to these Terms. If you don't agree, please don't use the app.
1. Your license to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to use Focus Kitten on Macs that you own or control. You may not copy, resell, reverse-engineer, or redistribute the app or your license key.
2. Purchases, subscriptions, and free trial
Focus Kitten offers a Monthly and an Annual subscription. Both renew automatically until you cancel.
Key things to know, wherever you bought:
- Free trial. New users get a 14-day free trial that requires no payment details — nothing is charged automatically. When it ends, the app invites you to buy; you're never charged unless you actively complete a purchase.
- Auto-renewal. A subscription renews automatically at the then-current price until you cancel. Cancelling stops future renewals; access continues until the end of the period you already paid for.
- Prices are shown on the purchase screen and may change over time; changes don't affect access you've already paid for.
- Refunds are described in our Refund Policy.
If you bought on focuskitten.com:
- Checkout & reseller. These orders are processed by Paddle.com Market Ltd (Paddle), our reseller and Merchant of Record. Paddle handles payment, tax/VAT, and billing support.
- License key. After purchase you receive a license key by email and on the confirmation page. Enter it in the app to activate it. A key may be used on a limited number of devices at a time.
- Cancelling. Write to us, or use the link in your Paddle receipt email.
If you bought in the Mac App Store:
- Apple is the seller. Apple takes the payment, issues the receipt, and handles billing support. There is no license key — your subscription travels with your Apple Account.
- Cancelling. Manage or cancel the subscription in your Apple Account settings. We cannot cancel it for you, and neither can we see it.
- Refunds for these orders are requested from Apple, not from us — see the Refund Policy.
- Apple's terms. Your use of the app is also subject to the Apple Media Services Terms and Conditions, and section 12 below applies.
3. Acceptable use
Please use Focus Kitten as intended — to help you focus. Don't use it unlawfully, and don't try to break, disrupt, or gain unauthorised access to the app or its services.
4. Your content and feedback
The app is yours to enjoy; your kitten, its name, and your progress belong to you and stay on your device. If you send us feedback or suggestions, you allow us to use them to improve Focus Kitten without any obligation or payment to you.
5. Intellectual property
Focus Kitten — including its name, artwork, the kitten character, animations, sounds, and code — is owned by us and protected by intellectual-property laws. These Terms don't give you any rights to our branding or assets beyond using the app itself.
6. Third-party services
The app and website rely on third parties — Paddle (payments, billing, tax) and Keygen (license activation) for orders made on focuskitten.com, Apple (payments, subscriptions, receipts) for orders made in the Mac App Store, Resend (delivering your license key by email), and Mixpanel (privacy-friendly usage analytics). Their handling of data is described in our Privacy Policy. We're not responsible for third-party services beyond our own use of them.
7. Disclaimer
Focus Kitten is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We don't promise the app will be uninterrupted, error-free, or that it will make you productive — it's a friendly nudge, not a guarantee.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the app. This does not affect your mandatory statutory consumer rights.
9. Termination
You can stop using Focus Kitten and delete it at any time. We may suspend or end your access if you breach these Terms. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability) continue to apply after termination.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date above.
11. Governing law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. Any mandatory consumer-protection rights available to you in your country of residence still apply.
12. If you got the app from the Mac App Store
The following applies only to copies downloaded from the Mac App Store, and Apple requires us to say it plainly:
- These Terms are between you and us alone. Apple is not a party to them, and we — not Apple — are solely responsible for Focus Kitten and its content.
- Your licence is non-transferable and covers Apple-branded devices you own or control, as set out in the Usage Rules of the Apple Media Services Terms and Conditions.
- Support. We are solely responsible for support. Apple has no obligation to provide any maintenance or support for Focus Kitten. Write to us at hello.focuskitten@gmail.com.
- Warranty. We are solely responsible for any warranty, whether given or implied by law. If the app fails to conform to a warranty, you may tell Apple and Apple will refund what you paid for it; to the extent the law allows, that is Apple's entire obligation, and any other claim is ours to answer.
- Claims. We, not Apple, are responsible for addressing any claim about the app — product liability, a failure to meet a legal requirement, or a claim under consumer-protection or similar law.
- Intellectual property. If a third party claims the app infringes their intellectual-property rights, we, not Apple, are responsible for the defence and settlement of that claim.
- Legal compliance. You confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
